The general conditions of sale of this online shop (hereinafter "conditions" ) regulate the purchase and sale contracts of the products (hereinafter "product / s" ) offered from the company D-Segno Srls, Via Casteo 1 / B, 35017 Piombino Dese (PD), Italy, VAT no. 05306300285, registered with the REA of Padova NR. 458862, through the site www.d-segnohomeoffice.it to users of the site (hereinafter "customers / and" ), in compliance with the regulations in force on electronic commerce and on contracts with distance.

All information contained on the site is in Italian. The customer declares to have read all the above information and general conditions of sale before placing the order.

The customer, before placing the order for the product, declares that the purchase of said product has no direct relationship with his professional activity, as the purchase is intended for personal use only.
The customer declares furthermore to have the legal capacity to undertake in accordance with the provisions of these general conditions.

 

1) Object

These general conditions of sale have as their object the definition of the rights and obligations of the parties in the context of a distance sale of goods offered in this online shop. These conditions of sale applied to orders are in force at the time of the order date.

2) Territory and coverage of the offer

This version of the general conditions of sale refers exclusively to sales made to consumers having their domicile or residence in Italy.

3) Prices

The prices displayed on the site are expressed in Euros and include VAT at 22% while shipping costs are excluded (See the "Shipping" section). The guaranteed price to the buyer is the one published on the site at the time of purchase and is to be considered final and cancels and replaces any previously published prices.

4) Receipt of the order

The images of the products are indicative and not binding and the products are not supplied as a trial.

Any order confirmation signed by the validation click constitutes an irrevocable commitment of the customer. Once confirmed, the order can only be canceled within 24 hours, after which the customer is obliged to pay. In compliance with the relevant laws, the customer can still withdraw from the contract within 14 days (see section Returns and Refunds in point 9).

5) Order confirmation

The contract is to be considered concluded only upon confirmation of the order by D-Segno. The customer will receive by e-mail a notification of receipt showing the order confirmation with all the constituent elements of the contract (article code, prices, delivery dates, shipping costs).

D-Segno reserves the right not to confirm an order for any reason relating in particular to a product supply problem or a problem concerning the order received.

6) Availability

The offers contained in this site will be valid as long as the products listed remain online and while stocks last.

D-Segno reserves the right to communicate to the customer by email the possible unavailability of one or more of the products purchased. In the event of the purchase of a product that is no longer available, D-Segno will refund the price and shipping costs incurred by the customer.

7) Payment

The customer who intends to proceed with the purchase of the products must express this desire through a request made directly on the site in the specifically dedicated section where, following the procedures indicated, he will send his purchase order and make the payment
payment of the consideration is due at the time of the order. The customer undertakes to pay the agreed price for the product ordered on the site (price of the products and transport) using the available payment methods (See the "Payment Methods" section).
In case of non-receipt by D-Segno of payment, D-Segno reserves the right to cancel the order. In the case of payment by credit card, D-Segno reserves the right to request the sending, within 24 hours, of the copy of the identity document proving the actual ownership of the credit card used, it being understood that, in the absence of the requested shipment, D-Segno may refuse the payment and cancel the order. If the payment is made by bank transfer, in case of non-receipt by D-Segno of the transfer within 7 days following the confirmation of the order, D-Segno reserves the right to cancel the order. The bank details are available in the “Payment Methods” section.

8) Retention of title

The ordered products remain the property of D-Segno until the final and full payment of their price (pursuant to Art. 1523 and following of the Italian Civil Code). D-Segno reserves the right to claim the ordered products in case of non-payment.

9) Delivery

The products are delivered to the address indicated by the customer.

The shipments will take place after receiving confirmation of payments: for the bank transfer the crediting to our current account is valid, while for the payment by credit card the confirmation of the transaction by the circuit is valid.

Delivery is to the street level unless otherwise indicated. The request for delivery to the floor of an order must be indicated by the customer at the time of the final confirmation of the order. D-Segno does not provide for the installation service of the products sold. The assembly of the products sold is extremely easy. D-Segno cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in the completion of the purchase order by the customer. Furthermore, D-Segno cannot be held responsible for any damage that may occur to the products after delivery to the carrier responsible for their transport as well as for delays in delivery attributable to the latter.

Shipments normally take place when all the goods are ready, but for different needs it is possible to contact customer service via email in order to guarantee maximum support. If in the order there are items with different delivery times , the customer can indicate in the notes during the check out phase any particular urgencies as the delivery time is determined by the product with longer processing time.

The delivery of products available in stock is made by express courier within 48 working hours in Italy, within 5 working days in Europe. In the case of large orders and / or particularly delicate products, the shipment is carried out by specialized couriers with delivery times varying in relation to the volume and destination of the goods. For products not in stock, the shipment takes place within a period of between 5 and 14 working days unless otherwise specified.

The delivery document issued by the carrier, dated and signed by the customer upon delivery of the product, will constitute proof of transport and release of the goods.
Upon delivery, the customer must check the content, conformity and status of the products
In the event of delays, failures, total or partial losses or other problems, the customer has the right to do recourse to the carrier without D-Segno's responsibility ever being taken into question.
Therefore, upon delivery, D-Segno recommends the customer to check the status of the products delivered before signing the receipt document .
In case of anomalies, the customer must refuse the delivery of the products or put in writing his reservations, detailed and dated. These reservations must be confirmed to D-Segno by certified email at the address d-segnohomeoffice@pec.it within three (3) working days following the delivery of the products. If the courier's document is signed without affixing any "reserve", the customer will not be able to make any objection about the external characteristics of what has been delivered.

Any delays in deliveries of less than 30 (thirty) days do not entitle the customer to refuse delivery of the products, nor to claim compensation or compensation of any kind.
D-Segno has the right to make, if it deems it appropriate, the request for delivery of the products (also relating to the same order) in several successive phases. Delivery is considered to have been made from the moment the product is delivered to the customer.

10) Failed delivery

In case of absence of the recipient during the delivery, the carrier will leave a notice of passage to the delivery address indicated by the customer. The products must be collected at the address and in the manner indicated by the carrier.

In case of failure to collect within the deadline set by the carrier, the products will be returned to D-Segno, which reserves the right to reimburse the price of the products, excluding any shipping costs that remain charged to the customer.

In the event of an error regarding the product, the customer undertakes to return said product or products concerned to D-Segno within 7 (seven) days of receipt, with the closed package, in their original state and packaging and with the documents delivery.
Once the product has been received in the correct form and manner, D-Segno will return, at its own expense, the product initially ordered.

1 1) Withdrawal, Returns and Refunds

The customer has the right to withdraw from the contract, without indicating the reasons, within 14 days from the delivery of the order. The withdrawal period expires after 14 days from the day on which the customer, or a third party indicated by him, acquires physical possession of the goods received.

To exercise the right of withdrawal, the customer must communicate his decision to withdraw from this contract by means of an explicit declaration, no later than the terms indicated above by sending an email to the address resi@d-segnohomeoffice.it

The address for the return shipment is indicated in the appropriate section and must take place within 14 days from the date on which the withdrawal from the contract was communicated. The direct costs of returning the goods will be borne by the customer. For the purposes of the deadline, the product is considered returned when it is delivered to the post office and / or accepting courier.

The customer is responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods. The returned goods must be returned in resalable conditions.
Please note, in the case of non-resalability , the amount equivalent to the decrease in the value of the asset can always be withheld.

The costs of returning the goods are charged to the customer.If the customer exercises the right of withdrawal in accordance with the provisions of these conditions of sale, D-Segno will refund the sums paid by the customer on the same payment method used by the customer for the original transaction (credit card, paypal, bank transfer ), unless otherwise indicated by the customer

The refund will be made, free of charge, within 14 days from the date on which D-Segno became aware of the customer's exercise of the right of withdrawal.

10) Force majeure

In addition to those normally considered by jurisprudence, the following cases are considered as cases of force majeure:
- total or partial strikes, internal or external to the company, the blocking of means of transport or supply for any reason, governmental or legal restrictions, computer failures, blocking of telecommunications including networks and in particular the internet.
In the event of force majeure, the execution of the 'order.
If after a period of 3 (three) months and the parties ascertain the persistence of the case of force majeure, the order will be automatically canceled, unless otherwise agreed by both parties.

11) Warranty

All products undergo quality control procedures before being shipped. However, in the event of problems, the customer benefits from the legal guarantee by D-Segno for a period of 24 months or 48 months for some items as reported in the products section provided that normal and compliant use has been made. the recommendations reported in the documents attached to the products and in the relative instruction booklets.

Without prejudice to the hypotheses of willful misconduct or gross negligence by D-Segno, it is now agreed that, if D-Segno is responsible for any reason towards the customer - including the case of non-fulfillment, total or partial, to the obligations assumed by D-Segno towards the customer as a result of the execution of an order - the responsibility of D-Segno cannot exceed the price of the products purchased by the customer and for which the dispute has arisen. t11>

D-Segno does not give any guarantee regarding the compatibility of the products with other products or equipment used by the customer, nor does it give any guarantee regarding the suitability of the products for the specific use intended by the customer.

12) Personal data

D-Segno is the owner of the personal data collected at the time of registration on the site, as well as those subsequently communicated at the time of purchase by the customer, excluding data relating to the payment procedure for which reference should be made to banking institutions through which the transaction takes place. For information relating to the processing of personal data, including the rights referred to in art. 7 of Legislative Decree 196/03, please refer to the detailed information provided in the appropriate section.

13) Electronic signature

The "validation click" constitutes an electronic signature and has, between the parties, the same value as a handwritten signature.

14) Contractual integrity

These general conditions of sale constitute the entirety of the obligations of the parties.
No other general or particular condition communicated by the customer can be inserted or excluded from these general conditions.

15) Nullity

Should one or more provisions of these general conditions be considered invalid or declared as such in application of a law, regulation or following a final decision taken by a competent jurisdiction, the other provisions will retain all their force and value. .
